20. Piano Competition by @Pianotaste with Bösendorfer

Conditions of participation – as of September 25th, 2022
The organizer of the competition is Dr. Elisa Kafritsas (hereinafter referred to as organizer). These conditions of participation apply to the "Piano Competition by @pianotaste".
20. Piano Competition by @pianotaste
Participation in the competition is free of charge.
The participant video (Reel) must be uploaded on Instagram between October 21 - October 23, 2022
The participant's Instagram account must be public.
1. Participation
To participate in the piano competition it is necessary to subscribe to @pianotaste and, if applicable, to the Instagram account of Bösendorfer and to the Instagram accounts of the jury members provided that these Instagram accounts have not yet been subscribed to, as well as to link a video (Reel) to the Instagram account @pianotaste each within the participation period between October 21 - October 23, 2022 with a piano piece posted in the Instagram account of the participant with the hashtag #pianotastecompetition20professional for category professional pianists (pianists, who are undergoing or have completed professional musical training) OR with the hashtag #pianotastecompetition20amateur for category amateur pianists (a pianist, who is not allowed to earn his living by playing the piano and has not studied piano either). Aditionally hashtags are allowed.
The video must show and allow to hear a piano piece PART (the video length must be 59 seconds) performed by the participant.
The participant plays a piece of his choice. Only classical music is to be performed. The composer must have died more than 70 years ago.
The video must show the following information: Piano Competition by @pianotaste, name of the music piece and of the author(s).
The participant must be seen in the video (head, arms, hands). No other people may be seen in the video.
The video may only contain the two-handed piano piece of the participant. Protected objects such as paintings may not be shown on the video either. In addition, no statements shall be recorded beyond the musical performance nor texts, trademarks or other signs shall be displayed in the video.
Participation in the competition is possible during the period October 21 - October 23, 2022. Registrations received after this time will not be considered. Organizer is not liable for technical or other transmission problems of data during registration, unless Organizer is responsible for them. DEADLINE: October 23, 2022 GERMAN TIME: 11:59 p.m.
All piano players from 16 years without age limit are eligible to participate. Minors may only participate with the prior consent of their legal representatives (e.g. parents) in the participation and these conditions of participation. Upon request, participant must present the consent of the legal representatives at any time and Organizer is authorized to demand the identification and authorization of the person giving consent the consent, verification and authorization is not submitted within seven days or if it is insufficient, the participant will be excluded from the competition and eventual winnings may be claimed back. The participant must inform the Organizer of his / her age and country of residence by message via the email address of the Organizer pianotaste7@gmail.com.
Only one participation per competition is possible. If from the same participant or from the same Instagram account a second or several videos are uploaded, the participant will be disqualified.
The personal data provided by the participant during registration must be completed and truthful.
With uploading the video and with linking to the Instagram account @pianotaste the participant agrees to the conditions of participation.
2. Exclusion from participation
Relatives or students of the jury are excluded from participation, as well as relatives of the Organizer.
3. Determination of the winners
Each video properly provided has a chance to win. A jury, selected by the organizer, will determine the winners.
4. Prize
Category professional pianist:
1st place: 150 EURO + Pianotaste wristband + certificate + announcement in feed and story on the Instagram account @pianotaste with over 80.000 follower
2nd place: 50 EURO + announcement in feed and story on the Instagram account @pianotaste with over 80.000 follower
Category amateur pianist:
1st place: 150 EURO + Pianotaste wristband + certificate + announcement in feed and story on the Instagram account @pianotaste with over 80.000 follower
2nd place: 50 EURO + announcement in feed and story on the Instagram account @pianotaste with over 80.000 follower
The prizes to be won are only awarded once. A winner receives only one prize. The prizes can be provided by sponsors, which will be pointed out- if necessary, highlighted- during the competition. The costs incurred by the transmission of the prizes be borne by the Organizer or an eventual prize sponsor. If the prize of the competition constitutes a taxable benefit for the winner, the obligation to pay taxes rests with the winner.

5. Notification of the winners and publication in the ranking list The winners will be notified via a personal Instagram message. For the transmission of the prize, the winner must provide via the email of the Organizer pianotaste7@gmail.com the data requested by the Organizer (address, e-mail address, bank account details, etc.) immediately, not later than one day from notification. If it is not possible to contact a winner, if he/she does not react immediately (not later than one day from notification) or if he/she does not provide the information requested for the determination of the prize within the period mentioned, his/her claim to the prize shall be forfeited without compensation. In these cases, the organizer can reassign the prize at its own discretion.
6. Manipulation Any form of manipulation of the competition is prohibited. This applies in particular in the event that the participant does not provide the pianist's performance himself.
7. Consequences in the event of infringements In case of violations of these conditions of participation or legal regulations by participants, the Organizer reserves the right to exclude the participant from participation. This applies in particular in the event of false information about the participant's person or manipulation of the competition (see no. 5). Exclusion results in the forfeiture of any claim to a prize without compensation and can also take place subsequently with the consequence that a prize can be claimed back. The Organizer expressly reserves the right to make other claims.
8. Rights to content and rules of conduct The Organizer is authorized, but not obliged, to place the winner videos with the pianist performances on the Organizer’s Instagram stories. In addition, the Organizer may mark the winner posts with the note "piano competition by @pianotaste", as well as the respective placements The videos may be linked to the account of the winners. The winners can delete the video at any time.
For clarification purposes: The linking from the Organizer’s Instagram account @pianotaste to the video released in the account of the participant is permitted in perpetuity. The participant reserves the right to delete the video.
By linking the video in its own Instagram account, each participant confirms that he/she is authorized to do so as well as to the authorization of the use by the Organizer according to paragraph 1 and 2 of section 7. The participant must effectively obtain any third-party rights required for this. This applies in particular to the rights to the music (musical works and any sound recordings used) and the rights of the filmmakers (e.g. cameraman).
The videos may not contain any political, religious, fascist, discriminating, insulting, advertising and/or illegal content. This also applies to viruses, trojans and other malware.
9. Liability Organizer is liable without limitation if the cause of damage is based on intent or gross negligence. Furthermore, Organizer shall be liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner regularly relies. In this case, however, Organizer shall only be liable for foreseeable damage typical for the contract. Organizer is not liable for the slightly negligent breach of obligations other than those mentioned in the above sentences. The above limitations of liability shall not apply in the event of injury to life, body or health or in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected. As far as the liability of the Organizer is excluded or limited, this also applies to the personal liability of representatives and vicarious agents of the Organizer.
10. Miscellaneous Solely responsible for the action is the Organizer. Participant fully releases Instagram from liability. The Promotion is not affiliated with Instagram and is in no way sponsored, endorsed or organized by Instagram.
All recourse to legal action is excluded.
Should any of these terms and conditions be or become invalid, the validity of the remaining terms and conditions shall not be affected.
